Judge Mazzant's denial of the motion for an emergency stay was essentially a purely procedural matter. It was necessary to get the motion appealed to the Circuit Court level. Your assertion has no basis in fact at the moment, as it's fairly unusual for a Circuit Court to even grant a hearing on an appeal of a denied motion for an emergency stay. This is not a good development for Zeke or his owners. 

 

The 5th Circuit is the most conservative in the country and not union-friendly in the slightest. I could easily see them pointing to the 2nd Circuit case law and determining that Zeke and the NFLPA are highly unlikely to succeed on the merits, thereby staying the injunction and starting Zeke's suspension immediately. .

Or something. The Elliott case is getting so bogged down in legalese we're thinking about forcing one of our younger writers to go to law school. The matter appears to now be in the hands of the Fifth Circuit. A ruling is not expected any time soon, meaning Zeke will probably be available for all 16 2017 games

This is written by a non-lawyer who is completely unfamiliar with the judicial process. The ruling on the emergency stay will come very quickly after the hearing on the motion.

 

The case on the merits won't be resolved any time soon, but the ruling on the injunction will not take long.

And now that appeal is being heard in the next couple of weeks.

The lowest level court said Zeke shouldn't be suspended until the entire case is heard and decided, so the judge issued what is called an injunction, which stops the NFL from making Zeke serve his suspension until the entire case is resolved.

I'm surprised Rotoworld hasn't updated that. How soon will a ruling take place once the appeal is heard?

 

So looks like Zeke is good for the next 3 games and he may be suspended after the bye....?

Appreciate that! So it sounds like he'll likely serve his suspension starting that week or soon after?

The Fifth could hear oral argument on the stay as a proxy for the appeal on the injunction or do an accelerated briefing schedule after the arguments and no oral for the appeal, but still decide this year.

I still think this gives Zeke a good shot at playing this season. I mean, the Fifth Circuit Court is simply going to be hearing all the same arguments that caused the injunction to be granted in the first place no?

I don't think they're hearing the entire case. Pretty sure I just read the court ordered the two sides to submit a 5 page something and it will be finished after October 2nd. But I'm not a law major.

Let's just call it what it is... the so called experts know nothing. First he has no chance, then he'll play all season, then he'll be out starting week 2, then he'll play all season, then he'll be out week 5.

 

If you're a gambler, like I am, keep him and get 6-1 money chance if he plays the season. If you're scared, try to pawn him off on a desperate 0-2 team as two high chance wins to even up the record. 

 

Most teams that have him should be 1-1 at best after the week 2 dud unless they faced a bigger dud like Jordy Nelson.

It's more legal drama that further muddles Zeke's status. Coming off a career-worst game at Denver, Elliott's rest-of-season outlook is trending down.

WTF?  One bad game and now RW is ready to say he's a bum?

I thought all the talk about this legal mumble jumble was that the motion was going to be denied, or whatever needs to happen to allow him to play the whole season.  What are the odds that he has to serve the suspension this year?  I thought all the legal experts were saying it was very very low.
